ESPR Destruction Ban Compliance. Methodology, Calculation, Certificate.
From 19 July 2026, fashion brands and footwear companies placing products on the EU market must evidence a legitimate derogation for every destruction event or stop destroying. The Invalusys methodology provides the cost-effectiveness calculation, grading taxonomy, and Article 3 documentation that makes destruction decisions legally defensible.
Derogation Methodology
A structured framework mapping each item to the ten derogation grounds under Article 2 of Delegated Regulation C(2026) 659. Every destruction decision traceable to a specific legal basis.
Cost-Effectiveness Calculation
The DER-NCE engine applies the Article 1(2) statutory test: repair cost versus the total cost of destruction plus full replacement. Not residual value. Not a desktop estimate. Calculated from your own operational data with reconditioning benchmarks built in.
Audit-Ready Documentation
Article 3 requires five-year evidence retention, produced within 30 days of a regulatory request. The Invalusys methodology generates compliant documentation at the point of each grading and routing decision — not retrospectively.
What the Invalusys Methodology Delivers
The Invalusys methodology is a three-layer compliance and recovery framework: item-level grading against a standardised taxonomy, cost-effectiveness calculation under the statutory DER-NCE test, and certificate-grade documentation for every routing decision. Deployed through a single API with three endpoints.
CLARITY Grading Standard
Item-level condition grading across an A–E taxonomy mapped to CN code product categories. Grade determines routing: A exits to brand channels, B/C enter the recovery and cost-effectiveness assessment, D routes to derogation, E fast-tracks to destruction certificate.
DER-NCE Calculation Engine
The statutory cost-effectiveness test under Article 1(2). Compares expected net recovery against reconditioning cost, benchmarked from proprietary transaction and processing data. Determines whether destruction is economically justified at item level.
Derogation Mapping
Systematic assessment against all ten Article 2(a)–(j) derogation grounds. Each item mapped to the applicable legal basis with documented evidence chain. Independent grounds assessed first; sequential donation pathway triggered only where (a)–(g) do not apply.
Certificate Registry
Legally defensible destruction certificates issued per derogation event. Each certificate references the specific Article 2 ground, the DER-NCE calculation output, and the grading evidence. Registry provides five-year retention with 30-day retrieval as required by Article 3.
Article 3 Evidence Pack
Complete documentation generated at each decision point: quality assessment procedures, inspection records, cost-effectiveness calculations, and waste treatment operator statements under Article 4. Built during the grading process, not assembled after the fact.
Recovery Intelligence
Market recovery benchmarks by brand, category, grade, and season. Resale channel performance data. The same proprietary dataset that powers the DER-NCE calculation also shows where recovery rates can be improved — turning the compliance exercise into a margin opportunity.
API Integration
Three endpoints: /calculate (DER-NCE assessment), /certify (certificate issuance), /outcome (routing confirmation). System-agnostic. Connects to existing WMS, ERP, or returns management platforms without workflow disruption.
Partner & Auditor Licensing
White-label API access for compliance partners, Big Four practices, and ESG consultancies. Partner accreditation programme. Methodology licensing that allows partners to certify their own brand clients against the Invalusys standard.

InValusys FAQs:
.
What is the Invalusys methodology?
The Invalusys methodology is a compliance and certification standard for ESPR Article 25 destruction ban derogations. It provides a structured framework for grading unsold consumer products, calculating cost-effectiveness under the statutory DER-NCE test, and generating the Article 3 documentation required for regulatory inspection. The methodology is system-agnostic and deployed through API integration or managed service
What is the Recovery Analysis?
The Recovery Analysis is a paid diagnostic programme that validates the DER-NCE methodology using a brand’s own operational data. It identifies the cost-effectiveness position across product categories, quantifies the recovery improvement opportunity, and produces a compliance readiness assessment. Two tiers: single-category (£7,500–£12,500) and multi-category (£18,000–£30,000), depending on the scope of stock categories and data complexity. inspection. The methodology is system-agnostic and deployed through API integration or managed service
Who operates the Invalusys methodology?
RMX Trading Ltd is the exclusive licensed operator of the Invalusys methodology in the UK and EU markets. Invalusys Ltd holds the methodology standard and certification IP. For brands, the distinction is simple: you engage with RMX for operational delivery, and the certification you receive carries the Invalusys standard.

What is the DER-NCE calculation?
DER-NCE stands for Destruction Event Review — Net Cost Effectiveness. It applies the Article 1(2) statutory test from Delegated Regulation C(2026) 659: whether the cost of repairing or refurbishing a product outweighs the total cost of destroying that product plus the full cost of replacing it — including materials, manufacturing, packaging, transport, stocking, and administrative expenses. This is a full replacement cost comparator, not a residual value test.
